When is a property gift the right choice?

Gifting a property is the fastest and most cost-effective way to transfer ownership – provided it takes place between close relatives. Under the current duty legislation, a gift is completely exempt from duty if it is made between the following persons:

  • Lineal relatives (parent and child, grandparent and grandchild)
  • Spouses
  • Siblings (including half-siblings)

If the gift is not made within the above circle of relatives, the duty rate is 9% for residential property and 18% for all other property (e.g. plot, garage, holiday home). In such cases, our office provides tax and duty optimisation advice to help you decide whether a gift or a sale is the more advantageous solution.

What costs does a gift agreement involve?

During the transaction, you should expect the following fixed, predictable costs:

  1. Attorney’s fee: 0.2% of the property’s market value + VAT, but at least HUF 110,000 net. The fee covers advice, drafting of the document, countersignature and full handling of the land registry procedure. There are no hidden costs.
  2. Land registry procedural fee: HUF 10,600 per property.
  3. Title deed request: HUF 4,800 (if the clients have used up their two free requests per year).
  4. Property acquisition duty: HUF 0 for gifts within the family.

The gifting procedure step by step

1

Initial contact and data collection

You contact our office, and we request the personal details of the donor and the recipient, as well as the property’s topographical lot number.

2

Checking the title deed

We obtain an up-to-date title deed and check whether the property is free of encumbrances or whether it is subject to any encumbrance (e.g. a prohibition on alienation and encumbrance, a mortgage) that would prevent the gift.

3

Identification of the parties (JÜB check)

We carry out the mandatory official identification of the parties. As part of the Legal Transaction Security Check (JÜB), we verify online in the central register the validity of the identity documents and address cards.

4

Sending the draft agreement

We prepare the draft agreement and send it to you by email for prior review and approval.

5

Signing the agreement

Signing can take place in person at our Budapest law office or, where the legal conditions are met, even by remote identification (Google Meet).

6

Land registry procedure

Immediately after signing (usually on the same day), we submit the agreement electronically to the competent land registry office. We send our clients the electronic document confirming the submission.

Frequently asked questions

The law does not specify who must pay; it is up to the parties to agree freely. The most common practice is that the acquiring party (i.e. the recipient) bears the costs of concluding the agreement and of the land registry registration.

Once the agreement has been signed and submitted to the land registry office, a “pending entry (marginal note)” is immediately recorded on the property, which already protects the recipient. The final registration of ownership itself takes 30–60 days, depending on the workload of the land registry office.

Yes, a minor child can also acquire property by way of a gift. If the property is free of encumbrances, the parent signs the agreement as the child’s legal representative. If the property is encumbered (e.g. by a loan), the prior approval of the guardianship authority is also required.

This is a very common situation. Parents often gift a property to their children while reserving their own lifelong usufruct (haszonélvezeti jog) in the gift agreement. Our office will, of course, also handle the establishment of the usufruct as part of the transaction.

No. Since the donor earns no income from the gift, there is no personal income tax liability either. However, if the recipient later sells the property (within 5 years), a tax liability may arise if the recipient earns income from the sale.

Only in very strict cases defined in the Civil Code (Act V of 2013) (e.g. a serious wrong committed by the recipient against the donor, or where the donor’s subsistence is endangered). As a rule, a gift cannot be reclaimed merely because the relationship between the parties has deteriorated.
